1. Agreement

These Terms of Service ("Terms") are an agreement between you and CommaScale LLC ("CommaScale", "we", "us"). By using commascale.com or any CommaScale service that links to these Terms, you agree to them. If you do not agree, please do not use the website or services. Some CommaScale products, and any client engagement, have their own terms or written agreements; where those conflict with these Terms, they control for that product or engagement.

2. Our website and services

CommaScale designs and builds software. This website describes our work and lets you contact us. Information on the website is provided for general purposes and may change without notice. Sending us an inquiry does not create a client relationship or any obligation to provide services; that happens only under a separate written agreement.

3. Acceptable use

You agree not to use the website or services for any unlawful, fraudulent, abusive, or harmful purpose, including attempting to gain unauthorized access, interfering with their operation, sending spam or malicious content, or scraping them in a way that burdens our systems. We may restrict or block access that violates these Terms.

4. Intellectual property

The website, its content, and CommaScale names and logos belong to CommaScale LLC or its licensors. You may view and share pages for personal or internal business reference, but you may not copy, modify, or reuse our content or branding for other purposes without our permission. Anything you send us remains yours; you give us permission to use it to respond to you and evaluate your inquiry.

5. CommaScale Social

CommaScale Social is an internal tool, hosted by CommaScale at social.commascale.com, that authorized CommaScale staff use to schedule and publish marketing content for CommaScale's own products to TikTok and Instagram accounts owned by CommaScale. It is not a public service and is not available for sign-up. Access is limited to people CommaScale authorizes, who must:

  • connect only accounts that CommaScale owns or is authorized to manage;
  • publish only content CommaScale has the rights to, that is accurate, and that complies with applicable law and platform rules;
  • keep their access credentials secure and not share them; and
  • use data received from TikTok or Meta only to publish and manage CommaScale's own content, as described in our Privacy Policy.

We may suspend or remove access to CommaScale Social at any time.

6. Third-party platforms

CommaScale Social works with services we don't control. Use of those services is subject to their own terms and policies, including:

TikTok and Meta are not parties to these Terms and are not responsible for CommaScale Social. Their features, permissions, and availability may change, and we are not responsible for their actions or outages. You can revoke CommaScale Social's access to an account at any time in the platform's settings.

7. Privacy

Our Privacy Policy explains how we handle information from the website and from CommaScale Social, including how to request deletion.

8. Disclaimers

The website and services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that they will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by law, CommaScale LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the website or services. Our total liability for any claim relating to them is limited to one hundred U.S. dollars (US$100), unless a written agreement with you says otherwise.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the website or services will be brought in the state or federal courts located in Delaware, and you and CommaScale consent to the jurisdiction of those courts.

11. Changes and termination

We may update these Terms from time to time; the date at the top shows the latest version, and continued use after an update means you accept it. We may change, suspend, or discontinue any part of the website or services at any time.
